  • Camp is four days a week (Monday-Thursday). Fridays will be used as the rain date in case of any inclement weather.

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AND PARENTAL CONSENT AGREEMENT

 

('AGREEMENT') 

  

IN CONSIDERATION of being permitted to participate in any way in the AROUND THE HORN facility activities ('Activity') I, for myself for personal representatives, assigns, heirs, and next of kin: 

  

  1. ACKNOWLEDGE, agree, and represent that I understand the nature of such activities and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity. 
  2. FULLY UNDERSTAND THAT: (a) AROUND THE HORN ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ('RISKS'); (b) these Risks and dangers may be caused by my own actions or inaction’s, the actions or inaction’s of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE 'RELEASEES' NAMED BELOW; (c) there may be OTHER RISK AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation or that of the minor in the Activity. 
  3. HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE AROUND THE HORN, their respective administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owner and lessors of premises on which the Activity takes place, (each considered one of the 'RELEASEES' herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE 'RELEASEES' OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releases, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim. 
  4. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT. 

 

COMMUNICABLE DISEASES

 

It is my intent as a participant that I am agreeable to the following:

 

I acknowledge that I am aware that there are risks to me of exposure to directly or indirectly arising out of, contributed to, by, or resulting from:

 

An outbreak of any and all communicable disease, including but not limited to, the virus “severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2)”, which is responsible for Coronavirus Disease (COVID-19) and/or any mutation or a variation thereof;  

 

In consideration of having the opportunity to participate as either a team member or competitor, and in acknowledging that I am aware of and willing to assume the risks associated with this activity, I hereby voluntarily agree to waive, hold harmless and indemnify AROUND THE HORN and its trustees, agents, volunteers and employees from any and all claims, demands, damages and causes of action of any nature whatsoever arising out of ordinary negligence which I, my heirs, my assigns or successors may have against them for, on account of, or by reason of my participation in the above activities. 

 

MINOR RELEASE

  

AND I, THE MINOR’S PARENT AND/OR LEGAL GUARDIAN, UNDERSTAND THE NATURE OF AROUND THE HORN ACTIVITIES AND THE MINOR’S EXPERIENCE AND CAPABILITIES AND BELIEVE THE MINOR TO BE QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH ACTIVITY. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEE’S FROM ALL LIABILITY CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON THE MINOR’S ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE 'RELEASEES' OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATION AND FURTHER AGREE THAT IF, DESPITE THIS RELEASE, I, THE MINOR, OR ANYONE ON THE MINOR’S BEHALF MAKES A CLAIM AGAINST ANY OF THE RELEASEES NAMED ABOVE, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE, OR COST ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM. 

 

POSTPONED, RESCHEDULED, AND CANCELLED EVENTS, GAMES, PRACTICES, AND CLASSES SCHEDULES

 

While every effort is made to provide accurate and up-to-date information, AROUND THE HORN and Event coordinators reserve the right to change, without notice the scheduling of Events, Games, Practices, and Classes schedules.  Parents are required to have a valid account within our Team Management or Registration system, mobile phone number and email address to make sure they are aware of any schedule changes.

 

WEATHER POLICY

 

There are times when the weather becomes a factor for Events, Games, Practices, and Class schedules.  AROUND THE HORN and Event Coordinators will try to adhere to the original schedule to the fullest extent possible.  You understand and agree to the factors weather may play into the scheduling. CANCELLATION AND REFUND POLICY

 

ALL DEPOSITS AND FEES ARE NON-REFUNDABLE.

 

ALL REQUESTS FOR REFUNDS ARE TO BE MADE IN WRITING WITHIN 14 DAYS OF THE PARTICIPANT'S REGISTRATION DATE.

 

RELEASE & MEDICAL CONSENT

 

 

I hereby give permission for my child/children to receive any medical attention necessary to be administered to my child until such time as I may be contacted. I hereby authorize any Officer, Coach, Assistant Coach, or representative of the AROUND THE HORN, to transport the registered child (ren) for any medical attention. I hereby give my consent for all medical care, including that prescribed or administered by a duly licensed Doctor or Dentist for the registered child(ren) under whatever conditions are necessary to preserve the life, limb or wellbeing of my child(ren). I hereby assume all risks and hazards incidental to my child (rens) participation at AROUND THE HORN including transportation to and from activities, and do hereby waive, release and absolve the Employees, Coaches, Sponsors, Supervisors and Representatives of AROUND THE HORN, from any claim arising out of any injury to my child except to the extent and to the amount covered by accident liability or medical insurance.

 

 

CODE OF CONDUCT

 

 

Players, coaches, officials, parents and spectators are to conduct themselves in a manner that demonstrates respect to other players, coaches, officials, parents, spectators and fans. In becoming a member of this organization, an individual assumes certain obligations and responsibilities to the organization and its participants. The essential elements in this Code of Conduct are HONESTY and INTEGRITY. Those who conduct themselves in a manner that reflects these elements will bring credit to themselves, their team and their organization. It is only through such conduct that our organization can continue to earn and maintain a positive image and make its full contribution to our sport and community.

 

 The following essential elements of the Code of Conduct must be followed:

 
  1. Sportsmanship and teaching the concepts of fair play are essential to the game and must be taught at all levels and developed both at home and on the field during practices and games.
  2. The value of good sportsmanship, the concepts of fair play, and the skills of the game should always be placed above winning.
  3. The safety and welfare of the players are of primary importance.
  4. Players should always demonstrate positive behavior and respect toward teammates, opponents, coaches, officials, parents and spectators.
  5. Coaches, players, parents and spectators are expected to demonstrate the utmost respect for officials and reinforce that respect to players/teammates.
  6. Grievances or misunderstandings between coaches, officials or any other parties involved with the organization should be communicated through the proper channels and procedures, never on or about the field of play in view of spectators or participants.
  7. Spectators involved with the game must never permit anyone to openly or maliciously criticize, badger, harass or threaten an official, coach, player or opponent.
  8. Eligibility requirements, at all levels of the game, must be followed. Rules and requirements such as age, previous level of participation, team transfers, etc, have been established to encourage and maximize participation, fair play and to promote safety.
 

MEDIA RELEASE FORM

 

I hereby give permission to AROUND THE HORN to make and use photographs, videos, and/or audio recordings in which my child/children picture or image appears for all purposes and in all media and formats now known or later created including, without limitation, all promotional materials. I hereby waive any right that I may have to inspect or approve the finished product or products or advertising or printed matter that may be used in connection with this video, audio or photographs or the use to which it may be applied. I hereby irrevocably release and discharge AROUND THE HORN and its officers, directors, employees, and agents, from all claims, demands, and causes of action that I now have or in the future may have relating to the permitted use of my likeness. I agree that AROUND THE HORN will be the sole owner of all rights in the above-mentioned recordings. 

 

 

For parents/guardians of participants of minority age (Under 18 years old at the time of this registration) 

 

This is to certify that I, as parent/guardian with legal responsibility for this Participant, have indeed read this release and agreement and I agree, for myself, my heirs, assigns and next of kin, to release and hold harmless and waive subrogation to AROUND THE HORN and all others from any and all liabilities incident to my minor child’s involvement or participation in these outlined activities or programs, even if arising from the acts or omissions of AROUND THE HORN, to the fullest extent permitted by law. I further agree to instruct my minor child to comply with the stated and customary terms and conditions for participation in the program or activity itself. If they are behaving in such a way that is not in compliance with the terms and conditions for participation in the program or activity, I will remove my child from participation and bring such to the attention of the nearest AROUND THE HORN official immediately.

 

I have read and understood this release and agreement and agree to its provisions. I am not under their influence of any drugs, alcohol, or other intoxicants. I am not suffering from any illness or incapacity. I am over 18 years of age. (If not over 18 years of age, parent or guardian must sign.)
