RELEASE OF LIABILITY, WAIVER OF CLAIMS,
ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

This Agreement is made for the benefit of Bryan Fraser Volleyball and its directors, officers, coaches, employees, volunteers, contractors, facility operators, sponsors, and agents (collectively, the “Releasees”).
Bryan Fraser Volleyball will not permit my minor child (the “Participant”) to participate in any volleyball practices, training sessions, camps, clinics, games, tournaments, travel, transportation, or related activities (the “Activities”) unless I accept this Agreement.
1. ASSUMPTION OF RISK
I acknowledge that participation in volleyball involves inherent and foreseeable risks, including serious injury, concussion, traumatic brain injury, illness, permanent disability, and death. These risks may arise from physical contact, being struck by equipment, falls, facility or premises conditions, travel, acts or omissions of other participants, or the NEGLIGENCE of the Releasees. I freely and voluntarily assume all such risks, known or unknown, EVEN IF ARISING FROM THE NEGLIGENCE OR OTHER FAULT OF THE RELEASEES.
2. WAIVER AND RELEASE
To the fullest extent permitted by the laws of British Columbia, I, on my own behalf and on behalf of the Participant, waive any and all claims and release the Releasees from any liability for injury, loss, damage, illness, or death arising from or connected with the Participant’s involvement in the Activities, INCLUDING LIABILITY ARISING FROM NEGLIGENCE, BREACH OF STATUTORY DUTY (INCLUDING THE OCCUPIERS LIABILITY ACT), BREACH OF CONTRACT, OR ANY OTHER FAULT OF THE RELEASEES. This release is binding on me, the Participant, and our heirs, executors, administrators, and legal representatives.
3. INDEMNITY
I agree to indemnify and hold harmless the Releasees from any claims, demands, actions, or expenses (including legal fees on a full indemnity basis) arising from the Participant’s participation in the Activities, including claims brought on behalf of the Participant.
4. MEDICAL CONSENT AND FITNESS
I confirm the Participant is medically fit to participate unless disclosed in writing. I understand the risks of concussion and agree the Participant will not return to play without medical clearance if a concussion is suspected. I authorize the Releasees to secure emergency medical treatment if required and accept full financial responsibility for such treatment.
5. MEDIA CONSENT
I grant Bryan Fraser Volleyball permission to photograph or record the Participant for promotional and program-related purposes without compensation and waive any related claims.
6. GOVERNING LAW
This Agreement is governed by the laws of the Province of British Columbia. If any provision is held unenforceable, the remainder shall continue in full force and effect.
FINAL CONFIRMATION
I confirm that I have read and understand this Agreement, have had the opportunity to seek independent legal advice, and understand that I am giving up substantial legal rights, including the right to sue. I am the legal parent or guardian of the Participant and am signing this Agreement both on my own behalf and on behalf of the Participant.
