COVID-19 WAIVER

WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19 ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT In consideration of being allowed to participate on behalf of Collegiate Prep Basketball Academy athletic program and related events and activities, the undersigned acknowledges, appreciates, and agrees that: Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and, I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and, I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS (insert name of sports organization) their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (RELEASEES), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION) This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent provided by law.

 

STANDARD WAIVER

The undersigned (hereinafter referred to as the (Participant) acknowledges that he/she is freely and voluntarily participating in Collegiate Prep Basketball Academy programming. This participation may be in connection with recreational activities, competition activities or in connection with work related activities, either of which may include potentially dangerous activities or hazardous situations. In consideration of the Participant being allowed to participate, the Participant does release and shall hold harmless the owners, the facility partners, their owners, their officers, employees, independent contractors associated with, representatives, or agents from any and all loss, claim suit, award or judgment for injury or damage to person or property arising out of or related to the Participant’s participation as described above. This release shall cover injuries or damages resulting from all actions or omissions of those released, including such actions or omissions, which are negligent or are negligently performed. As further consideration for the Participant’s being allowed to participate, the Participant agrees to indemnify and hold harmless the owners, the facility partners, their owners, their officers, employees, independent contractors associated with, representatives, or agents from any and all claims or actions whatsoever for damages, compensation or otherwise, including attorney’s fees and costs they may incur, due to the Participant’s participation as described above, due to the actions of the Participant , or due to the presence of the Participant on the property. Participant hereby acknowledges that there are inherent risks of injury or damage in participating as described above. Participant further acknowledges that serious accidents occasionally occur during such activity and that persons participating in such activities occasionally sustain mortal or serious injuries and/or property damage as a consequence thereof. Knowing the risks and dangers of these activities, the Participant freely and voluntarily accepts and assumes any and all of the risks of injury or damage to person or property arising out of or related to Participant’s participation as described above and/or arising out of Participant’s presence on the Property. Participant has read the above and fully understands its provisions and has signed this Release and Indemnity Agreement.


 


 


Collegiate Prep Payment and Refund Policy

Once we approach the start date of a program we schedule and contract our coaches as well as reconfirm gyms. If players pull out for various reasons that affects our coach-to-player ratio and overall balance and we then become unnecessarily overstaffed in one area or another.

 

PAYMENT POLICY:

  • Online registration holds a slot for your child.
  • Payment in Full is expected once registration has been completed.
  • Checks payable to: CPBA and mailed to PO Box 88, Alpharetta, GA  30009
  • Your canceled check will act as your receipt and confirmation in a program. You will need to check your bank statements.
  • There is a $50 service fee on all returned checks.
  • We have a $100 nonrefundable processing fee for all participants once your payment has been deposited.
  • You may now pay online with a credit card.You agree to all terms and conditions associated with the credit card processing companies.

 

REFUND POLICY:

Refunds will only be considered if CPBA is notified at least 14 days prior to the start of the program you registered for. This includes but is not limited to any training, league or tournament. 

Our refund policy has these options:

1. Refund Program fee minus $100 nonrefundable processing fee or 

2. Credit your account for the full Program Fee to be used for a future program.

There are no refunds after a program begins. Virtually all of our programs “sell out”. We often turn people away for lack of space, therefore we can’t recoup additional players after a program begins.

When there is an act of God and facilities decide to close we have no control over this.There will be no refunds for days missed due to this. We will do what we can to make this day up but it is not guaranteed.

The processing of a refund could take up to 30 days or more once an official request has been made. At the beginning of a program our priority is organizing the players in the program and getting things under way.  Once we are into our routine on the court, we will process all refunds.

RECEIPTS/TAX ID NUMBER REQUESTS:

Beginning with our 2008 Fall Training program, all Requests for Receipts/Tax ID numbers must be in writing. These requests will be processed within 30 days after request is received.

Collegiate Prep is a legally registered and insured S-corporation in the state of Georgia. We are NOT a 501(3)(c).
