TERMS AND CONDITIONS
Please review the student athlete and parent information given to make sure there are no errors. Then please read and agree to the below waviers and policies.
“I”, “my” or “myself” is referring to the named Athlete/Participant or the Parent/Guardian of the Athlete/Participant, that voluntarily chooses to execute this waiver, with the understanding that this waiver is binding upon signature.
“Activity” includes, but is not limited to: Leagues, Clubs, Camps, Trainings, Huddles and Special Events.
“Organization” refers to the charity of the Fellowship of Christian Athletes Canada (FCA Canada/FCA Sports/FCA Coaching), and its partners (including partnering evangelical churches), sponsors, agents, affiliates, directors, employees, officers or volunteers.
WAIVER OF LIABILITY FOR ALL CLAIMS AND RELEASE OF LIABILITY: By agreeing below the Athlete/Participant and/or the Athlete/Participant’s Parent/Guardian understands, acknowledges and assumes the inherent risks in participating in the Activity, including, but not limited to: the potential for bodily injury, illness, permanent disability, paralysis, or loss of life; collision with natural or manmade objects; dangers arising from adverse weather conditions; imperfect venue or field of play conditions; equipment failure; Athletes/Participants of varying skill levels; inadequate safety measures; circumstances known, unknown or beyond the control of the Organization; negligence or omission of the Organization (collectively, the “Risks”).
In consideration to participate in the Activity, I, the above-named Athlete/Participant and/or the Athlete/Participant’s Parent/Guardian: (a) release, discharge and forever hold harmless the Organization from any and all liability for damages or losses arising as a result of the Risks of participation in or in connection with the Activity; (b) waive any right to sue the Organization in respect of all causes of action (including for injuries or illness caused by negligence of the Organization), claims, demands, damages or losses of any kind that may arise as a result of the Risks of participation in or in connection with the Activity, including without limitation the right to make a third party claim or claim over against the Organization arising from the same; and (c) I freely accept and fully assume all responsibility for the Risk and possibility of personal injury, death, property damage or loss resulting from my or the above-named Athlete/Participant’s participation in the Activity. Further, I understand that although the Organization has taken steps to reduce the Risks and increase the safety of the Activity, it is not possible for the Organization to make the Activity completely safe. I accept these Risks and agree to the terms of this waiver, even if the Organization is found to be negligent or in breach of any duty of care or any obligation to my or the above-named Athlete/Participant’s participation in the Activity. I, THE ABOVE-NAMED ATHLETE/PARTICIPANT AND/OR THE ATHLETE/PARTICIPANT’S PARENT/GUARDIAN ARE GIVING UP LEGAL RIGHTS TO ANY AND ALL FUTURE CLAIMS AGAINST THE ORGANIZATION.
UNDERSTANDING OF THE FELLOWSHIP OF CHRISTIAN ATHLETES (FCA): I, the above-named Athlete/Participant and/or the Athlete/Participant’s Parent/Guardian, agree to voluntary participate in the Activity denoted on this registration form. In addition, I understand that the Fellowship of Christian Athletes (FCA) is a nonprofit Christian-based sports charity, as registered with the Canadian Government (#749539128RR0001). Further, I understand that the Organization (noted above as FCA and includes its other official partners), does not officially represent the Canadian Government or any of its regional affiliates. To that point, I understand that the Activity is conducted/lead in partnership with local evangelical churches (as noted in the definition of the Organization). Therefore, biblical principles and applications are present in all verbal and written curriculum. The Organization welcomes and respects the religious, cultural and lifestyle backgrounds of each Athlete/Participant, but stands behind the Biblical vision, mission and values found at https://www.canadafca.ca/about.
CONSENT TO MEDICAL TREATMENT: In the event the above-named Athlete/Participant is injured or becomes ill during the Activity, and if the above-named Athlete/Participant is not able to make medical decisions (or if the Athlete/Participant’s Parent/Guardian is not present/contactable), I hereby authorize and consent for the Organization to arrange for and consent on my behalf, to emergency medical care and treatment (including tests and radiological exams, surgery, hospital admission, emergency medications as prescribed by medical personnel attending to myself or the above-named Athlete/Participant. Further, I understand and agree that I am responsible for full payment of all medical charges/expenses that are not covered by OHIP. I am aware that there are inherent and significant dangers, hazards and Risks associated with the participation in the Activity. Further, I understand that the Risks are relative to the personal state of fitness or health (physical, mental, and emotional) of the Athlete/Participant, and to the awareness, care and skill while participating in the Activity. I, or the above-named Athlete/Participant, understand to inform immediately, the Organization if any pain, discomfort, fatigue, or other symptom(s) occur during or immediately after, participation in the Activity. Further, I understand that this may result in myself or the above-named Athlete/Participant, being asked to stop participating by the Organization for safety reasons.
MEDIA RELEASE: I hereby authorize the Organization to use, reproduce, distribute, and display my or the above-named Athlete/Participant’s image, and photograph, as well as any video, digital, or audio recording or reproduction, in connection with external and internal communications of the Organization for the sole purpose of advancing the Organization’s programs. I acknowledge and consent that registration will allow the Organization to obtain access to personal information regarding myself or the above-named Athlete/Participant. Further, I agree that FCA Canada may use such personal information in a manner consistent with FCA Canada’s Conditions of Use and Privacy as amended from time to time. PARTICIPATIONS AND SAFETY: I understand that participation in the Activity to which I am registered may require various physical activities that could involve risk of injury to myself or other Athletes/Participants in the Activity. Further, I agree that, if required, I will provide a signed medical release from a licensed doctor (within Canada), as proof that myself or the above-named Athlete/Participant, are physically and mentally able to participate in the Activity.
AGREEMENT AND EXECUTION:
I agree to be liable for and to hold harmless and indemnify the Organization from all actions, proceedings, claims, damages, costs, or demands including court costs and costs on a solicitor and own client basis, and liabilities of whatsoever nature or kind arising out of or in any way connected with my or the above-named Athlete/Participant’s participation in the Activity.
I agree that this waiver and all terms contained within are governed by the laws of the Province or Territory in which I, or the Athlete/Participant, is participating in the Activity. I hereby irrevocably submit to the jurisdiction of the courts of that Province or Territory.
I agree that I have had sufficient time to read and understand each term in this waiver in its entirety and have agreed to the terms freely and voluntarily. I understand that this waiver is binding on myself, the Athlete/Participant and/or the Parent/Guardian of the Athlete/Participant.
I am either the Athlete/Participant above the age of majority or the Parent/Guardian of the Athlete/Participant and am executing this waiver on behalf of myself as the Athlete/Participant above the age of majority or as the Parent/Guardian of the Athlete/Participant in my capacity as the Parent/Guardian, with the intent understanding that this waiver is be binding for all purposes.
