RELEASE OF LIABILITY, WAIVER OF CLAIMS AND ASSUMPTION OF RISKS AGREEMENT
WARNING! By signing this document (the “Agreement”), you and the child named above (the “Child”) will waive certain legal rights, including the right to sue for or claim compensation following an accident:

Football Nova Scotia and affiliate member associations/teams including but not limited to, their directors, officers, employees, coaches, instructors, volunteers, agents, representatives, business operators, site property owners, members, (the “Association”) are not responsible for any death, injury, loss or damage of any kind suffered by any person while participating in any activities of Football Nova Scotia caused in any manner whatsoever, including but not limited to the negligence of the Association, whether passive or active.
In particular, the Association are not responsible for contraction of COVID-19, or any death, injury, loss or damage of any kind suffered by any person resulting from contraction of COVID-19 or other illness while participating in any activities of Football Nova Scotia and affiliate member associations/teams.

ACTIVITY DESCRIPTION

3. Participating in the activities of Football Nova Scotia and affiliate member associations/teams will include activity such as, but not limited to, warm-ups, training,
practice, games, competitions, pre-events and post-events (social activities), and travel to and from events. (Any and all of which are individually and collectively referred to in this document as the “Activity”).

DESCRIPTION AND ASSUMPTION OF RISKS

4. I am aware that participating in the Activity described above involves many risks, dangers and hazards, which include but are not limited to:

Risk of contracting illness such as COVID-19;
- COVID-19 is a serious health threat and can be deadly. While the risks are increased for individuals aged 65 and over, with compromised immune systems, or with underlying medical conditions, the contraction of COVID-19 presents a risk to every individual. The risks associated with this disease include risk of permanent health effects and death. Risk of contracting this disease may increase from activities that include contact with others, equipment, or surfaces which may be contaminated. These are among the risks inherent in the Activity.
Injuries, including breaks, sprains, strains, and dislocations, resulting from physical contact with playing surfaces, participants, spectators, or equipment;
Organ and ocular damage from physical contact with participants, equipment or playing surfaces;
Connective tissue injuries to tendons, ligaments, and cartilage;
Head injuries, including concussions, broken facial or cranial bones or teeth, and abrasions;
Tripping hazards or slip and falls resulting in serious injury or death;
Spinal cord injuries that may result in paralysis;
Joint injuries to shoulders, back or neck, and knees and ankles;
Risk of cardiovascular or cardiopulmonary distress or death;
Equipment malfunction and/or failure, or improper use of equipment;
Exposure to adverse weather conditions and/or irregular or negligent field maintenance;
Heat-related illnesses such as dehydration, heat exhaustion, and heat stroke;
Negligence on the part of other participants;
Negligence on the part of the Association, including the failure to take reasonable steps to safeguard or protect me from the risks, dangers, and hazards of participating in the Activity.

I understand the risks may be relative to my Child’s own state of fitness and health (physical, mental and emotional), and to the awareness, care, and skill with which my Child conducts themselves while participating in the Activity.   Furthermore, My Child and I are aware that injuries sustained and illness contracted through the Activity can be severe and potentially fatal.

My Child and I freely accept and fully assume all such risks, dangers and hazards, including, without limit, the risk of personal injury, death, property damage, and loss occasioned during or arising from my participation in the Activity however so caused.


RELEASE OF LIABILITY

5. In consideration of the Association agreeing to my participation in the Activity and permitting my use of their equipment and facilities, and for other good and
   valuable consideration, the receipt and sufficiency of which is acknowledged, I AGREE:

TO WAIVE ANY AND ALL CLAIMS that I or my Child have or may in the future have against the Association and to release the Association from any and all liability for any loss, damage, expense, injury, or illness including death, that my Child may suffer, as a result of their participation in the Activity due to any cause, including but not limited to negligence, gross negligence, breach of contract or breach of any statutory or other duty of care owed under the Occupiers’ Liability Act, S.N.S. 1996, c. 27, or the Common Law of Canada or Nova Scotia, on the part of the Association, and further including the failure on the part of the Association to take reasonable steps to safeguard or protect me from the risks, dangers, and hazards of participating in the Activity.
THAT in entering into this Agreement I am not relying on any oral or written representations or statements made by the Association with respect to the safety of participating in the Activity, other than as set forth in this Agreement. I am aware of the dangers involved in my Child participating in the activity and my Child’s participation is voluntary.
THAT I am particularly aware of the risks associated with the Activity for individuals with back or heart problems and other medical conditions. The Activity may require physical exertion which may be strenuous and may cause physical injury. To my knowledge, my Child’s physical condition is adequate for participating in the Activity and my Child has no pre-existing health condition that should keep them from participating in the Activity.
THAT I am particularly aware of the risks associated with the Activity for individuals who have a compromised immune system or have underlying conditions which make them more susceptible to the dangers of illness such as but not limited to COVID-19.
TO forever release, discharge, save harmless and indemnify the Association from any and all liability for any and all claims, demands, actions, damages (including, but not limited to, direct, indirect, incidental, special, and/or consequential), losses (economic/non-economic), judgments, executions, and costs (including legal fees and disbursements) which I or my Child may have or may in the future, that might arise out of my Child’s participation in those activities, events and programs of the Association or my traveling to and from, due to any cause whatsoever, including but not limited to the negligence, omission, carelessness, breach of contract, or breach of any duty of care by the Association.
THAT I have authority as the parent or legal guardian to enter into this Agreement;
THAT I have discussed with my Child the risks associated with the Activity; and
THAT my Child HAS my permission to participate in the Activity.
I understand that this Agreement is intended to be as broad and inclusive as permitted by the laws of the Province of Nova Scotia and agree that if any portion is held invalid, the remainder of the Agreement will continue in full legal force and effect. I further affirm that the venue for any legal proceedings shall be in the Province of Nova Scotia.

ACKNOWLEDGEMENT

I acknowledge that I have read this agreement, that I have executed this agreement voluntarily and with full knowledge of its content, and that I am aware this agreement is binding upon my Child, myself, our heirs, executors, administrators, and/or representatives.

Privacy Policy

THE COLLECTION, USE AND DISCLOSURE OF PERSONAL INFORMATION

Football Nova Scotia collects, uses, and discloses only such information from individuals as is required for the purpose of providing services or information to them, managing databases, conducting research and such other purposes as described in Football Nova Scotia’s Privacy Policy.

Football Nova Scotia does not sell, trade, barter, or exchange for consideration any Personal Information obtained. Football Nova Scotia’s collection, use and disclosure of personal information shall be done in accordance with its Privacy Policy, a copy of which is available at www.footballnovascotia.ca

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS

AND INDEMNITY AGREEMENT (the “Agreement”)

BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

PLEASE READ CAREFULLY!

In consideration for allowing me to participate in any or all of the promotional events, competitions, sports and/or activities on field at the CFL game between Toronto Argonauts and Saskatchewan Roughriders at Huskies Stadium, Saint Mary's University on July 28, 2023 (the “Event”), I hereby represent, warrant and agree that:

1. I am familiar with and accept that there is always the risk of serious injury and/or death resulting from my participation in the Event; and

2. I have satisfied myself, and believe, that I am physically, emotionally and mentally able to participate in the Event, and that my equipment, if applicable, is appropriate for use in the Event; and

3. I understand that all applicable rules for participation and "Covid Protocols" must be followed at the Event and that at all times the sole responsibility for personal safety at the Event remains with me; and

4. I will immediately remove myself from participation, and notify the nearest official, if at any time I sense or observe any unusual hazard or unsafe condition, or if I experience any deterioration in my physical, emotional or mental fitness, or if any activity in the Event exceed my comfort level; and

5. I permit Toronto Argonauts and Saskatchewan Roughriders, the Canadian Football League, CFL Enterprises LP and each of their affiliates, partners and related entities, and all others involved in the Event, including but not limited to, event organizers, sponsors, event venue, and each of their respective directors, officers, employees, representatives, agents, insurers, successors and assigns (collectively, the “Releasees”) to take photographs, videos or other recordings (collectively, the “Photographs and Videos”) of me at the Event. Further, I grant to the Releasees the right to use my name, Photographs and Videos, likeness, voice, image, statements, and biographical information at any time or times, for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide including the Internet, without review, notification or approval, and without any compensation, unless prohibited by law. I agree to waive any moral rights I may now or in the future have in the Photographs and Videos. I hereby release, indemnify and hold harmless the Releasees from and against any claims, damages or liability arising from or related to the use of the Photographs and Videos and any related materials thereto made by me, my family, estate, heirs or assigns now or in the future.

I UNDERSTAND AND AGREE, ON BEHALF OF MYSELF, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN THAT MY EXECUTION OF THIS DOCUMENT CONSTITUTES:

AN UNQUALIFIED ASSUMPTION BY ME OF ALL RISKS associated with my participation in any or all of the Event, even if arising from the negligence, omission or gross negligence, including any compounding or aggravation of injuries caused by negligent rescue operations or procedures, of the Releasees, and

2. A FULL AND FINAL RELEASE AND WAIVER OF LIABILITY OF ALL CLAIMS that I have, or may in the future have, against the Releasees from any and all liability for any loss, damage, injury or expense that I may suffer as a result of my participation in any part of, or presence at, the Event due to any cause whatsoever, INCLUDING NEGLIGENCE, GROSS NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE APPLICABLE OCCUPIERS LIABILITY ACT, ON THE PART OF THE RELEASEES.

3. AN AGREEMENT NOT TO SUE THE RELEASEES for any claim, loss, injury, costs or damages of any form or type, howsoever caused or arising, and whether directly or indirectly, from my participation in any aspect of the Event; and

4. AN AGREEMENT TO INDEMNIFY, and to SAVE and HOLD HARMLESS the RELEASEES from any litigation expense, legal fees, liability, damage, award or cost, of any form or type whatsoever, they may incur due to any claim made against them by me whether such claim is based on the negligence or the gross negligence of the Releasees or otherwise.

5. I agree that if any portion of this Agreement is held to be invalid or unenforceable, all other provisions shall nevertheless continue to be valid and enforceable. The Agreement supersedes any oral or written statements made by or to me in connection with my participation in the Event. I understand that I cannot terminate, cancel, or revoke the Agreement for any reason.

6. This Agreement be governed by the laws, and in the courts of the Province or Territory in which the Event is located, and operates to the benefit of the Releasees, and is binding on me and my heirs, administrators, successors, assigns, insurers, and estate.

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN SUBSTANTIAL LEGAL RIGHTS WHICH I AND MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST THE RELEASEES.
