Terms and Conditions For All Pluto Events

In connection with nationwide concerns of Covid-19 viruses and other health concerns, all parents and participants must understand there is a risk of coming into contact with this virus and other health risk factors within and without our Pluto facility and Pluto members and other permitted peoples. It is imperative that all parents and players must consider this risk and protect themselves by practicing healthy habits. Pluto is maintaining and cleaning its facility in effort to lower that risk.

I understand that in connection with responding to the COVID-19 pandemic:

Acceptance of Risk; Release; Indemnification. I am fully aware that there are a number of risks associated with me and/or my child entering in the Pluto facility or its associated facilities, becoming a member/or not, any training or other Pluto activities, attributed to the COVID-19 pandemic under the circumstances, including without limitation: (a) I and/or my child could contract COVID-19 or other diseases such as the flu or legionnaires disease which could result in a serious medical condition requiring medical treatment in a hospital or could possibly lead to death; and (b) I and/or my child or our visitors will be subject to normal risks associated with being in the Pluto gym or associated relations such as physical injuries or even death or loss or damage to personal property, including without limitation, from slips or falls, food poisoning or allergic reaction to food served in the said facility. On behalf of myself and/or my child or visitors, I knowingly and freely, assume all such risks, both known and unknown, relating to my and/or my child’s or visitor’s and being in the facilities’ as described above, and I hereby forever release, waive, relinquish, and discharge Pluto, along with their officers, directors, managers, officials, employees, volunteers, or other representatives, and their successors and assigns (collectively, the “Pluto representatives”), from any and all claims, demands, liabilities, rights, damages, expenses, and causes of action of whatever kind or nature, and other losses of any kind, whether known or unknown, foreseen or unforeseen, (collectively, “Damages”) as a result of me and/or my child or visitor being at the Pluto facility or any rental facilities or other associated facilities described above, including but not limited to those related to the above described personal Injuries, death, disease or property losses, or any other loss, and including but not limited to claims based on the alleged negligence Pluto and Pluto representatives or any other person. I further promise not to sue Pluto or Pluto Representatives in connection to the claims above, and to indemnify and hold them harmless from any and all Damages resulting from my and/or my child’s or visitor’s being at said properties.

-BASKETBALL RELEASE OF LIABILITY FORM-

*READ CAREFULLY In exchange for participation in the activity of Basketball Training organized by Pluto Basketball, and/or use of the property and services (camps, clinic, workouts, and such alike) of Pluto Basketball, I agree for myself and (if applicable) for the members of my family, to the following:

1. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Pluto Basketball, or the employees, representatives or agents of Pluto Basketball.

2. I recognize that there are certain inherent risks associated with this described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Pluto Basketball for injury, loss or damage arising out of my or my family's use of or presence upon the services of Pluto Basketball, whether caused by the fault of myself, my family, the instructor, or other third parties.

3. I agree to insure and defend Pluto Basketball against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the services of Pluto Basketball.

4. I consent to the participation of __________________________ for basketball training, and agree on behalf of the above minor (or myself if applicable) to all of the terms and conditions of this agreement. By signing this Release of Liability, I represent that I have legal authority over and custody of ______________________. (If applicable)

In the event of an injury to the above described activities, I give my permission to Pluto Basketball or to the employees, representatives or agents of Pluto Basketball to arrange for all necessary medical treatment for which I shall be financially responsible. This temporary authority will begin on the first day of training and will remain in effect until terminated in writing by the undersigned or when the above described activities are completed. Pluto Basketball shall have:

5. The power to seek appropriate medical treatment or attention on behalf of my child as may be required by the circumstances, including without limitation, that of a licensed medical physician and/or a hospital.

The power to authorize medical treatment or medical procedures in an emergency situation.

6. Any legal claim that may arise from participation shall be resolved under Colorado law.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY PARTICIPATING OR ATTENDING ANY PLUTO EVENT OR OCCASION THAT THIS IS A RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.

-Pluto Talent/Media Release Waiver-

Thank you for participating in Pluto Prospects Inc./Pluto Basketball llc.’s media platform. Footage and Information recorded will be used for Pluto Prospects Inc./Pluto Basketball llc’s media applications and websites and such other media platforms pertaining to aforementioned and their affiliates. (Pluto Prospects Inc, Pluto Basketball llc, and its administrators are referred to as Pluto)

I hereby authorize Pluto to publish photographs taken of myself and/or minor child or children listed below, and our likenesses, for use in the Pluto’s print, online and video-based marketing materials, social media, media applications, as well as other publications.

I hereby waive all rights of privacy or compensation, which I/my child may have in connection with the use of my name, picture, portrait, video, likeness or voice, or any or all of them, in or in connection with Pluto Prospects Inc. and Pluto Basketball Ilc. and its affiliates' media, including, but not limited to, web sites, still photography, motion picture film, television tape, film or sound track recording, media applications, social medias, and any use to which the same or any material therein may be put, applied or adapted by Pluto Prospects Inc. and it’s affiliates. I release Pluto Prospects Inc. and Pluto Basketball Ilc. and its governing board, officers, employees, affiliates and representatives from liability for any violation of any personal or proprietary right I may have in connection with such use(s). I understand that all such recordings, in whatever medium, shall remain the property of Pluto Prospects Inc., Pluto Basketball llc., and it’s affiliates. This consent and waiver will not be made the basis of a future claim of any kind against Pluto Prospects and any of its agencies.

I agree to uphold and honor the afore mentioned statements and information above. I understand that Pluto Prospects Inc. and Pluto Basketball LLC. will be recording workouts and such and I agree to allow the recording of myself and/or my child and recognize that all film recorded by Pluto Prospects Inc. and Pluto Basketball LLC. are to be used at their discretion, including, but not limited any monetary gain. I agree that any allowances gained from PlutoProspects Inc and Pluto Basketball LLC. of talent media that I and/or my child is apart of belongs to Pluto Prospects Inc. and Pluto Basketball llc.

Further, I attest that I am the parent or legal guardian of the child or children listed below and that I have full authority to consent and authorize Pluto to use their likenesses and names.

I hereby release Pluto, its contractors, its employees and any third parties involved in the creation or publication of Company publications or social media platforms, from liability for any claims by Pluto and it’s affiliates in connection with my participation and/or the minor child/children listed below.

READ CAREFULLY -- BY PARTICIPATING YOU AGREE TO ALL TERMS AND CONDITIONS AND ARE RESPONSIBLE FOR YOUR DECISION TO PARTICIPATE IN ANY PLUTO AND ASSOCIATED FACILITIES OR EVENTS. THIS IS A LEGAL DOCUMENT FOR PLUTO AND ITS ASSOCIATES.
